1. Introduction
Welcome to Emploi.com.ng, the service network store for services done by its users.
These Terms of Service (‘Terms’) govern your access to and use of Emploi. Please ensure you read these Terms carefully before using the site. In using the site and/or creating an account, you agree to accept and be bound by these Terms.
Key terms
Employees – are users who offer and perform/sell services on Emploi.
Employers – are users who purchase services by hiring Employees on Emploi.
Services – are offered by employee’s on Emploi for a fee.
Employer requirements – This is a field to be filled by the Employee when creating a service. It is what the Employee requires from the Employer in order to begin the task.
Revisions – are the number of times a delivered order can be modified or edited.
Custom Offers – are customised proposals that an employee offers an employer based on specific requirements made by the employer (such as price, delivery time, revisions).
Employer Request – Are requests made by an employer for specific or custom orders.
Employee Requirement – This is filled in by the Employer when creating an Employer request. It represents specific requirements an employee must possess that make such an employee eligible to handle the job.
Orders – are a formal agreement between an employer and an employee on the purchase of a service.
Earning – is the amount of money the employee earns from completed orders.
Emploi balance/Shopping balance – Is the amount available to users to withdraw or purchase services.
TopUP – is the process of funding your Emploi wallet to purchase services of Employees.
2. How the website works
For you to buy or sell on Emploi you MUST be registered on the site (emploi.com.ng)
Registration is free for both Employers and Employees
- Cost of Services may be set at any price not lower than ₦1,000 (One Thousand Naira)and not more than ₦5,000,000 (Five Million Naira). That is, a minimum of all ₦1,000 (One Thousand Naira, and a maximum of ₦5,000,000 (Five Million Naira)
- Employers pay for services in advance to create an order and payment is released to the Employee upon mutually agreed completion of the service.
- Users outside Nigeria can pay for services in their local currency. For currencies not supported payment can be made in US dollars. All currency conversion rates are subject to the terms and conditions of the payment processor (Vogue pay, Rave pay).
- Employees must endeavour to complete their orders, without cancelling orders unnecessarily or on a regular basis. Regular cancellation of orders will affect employees’ reputation and may eventually lead to service suspension.
- YOU MAY NOT OFFER OR ACCEPT ANY FORM OF PAYMENT FOR SERVICES ON EMPLOI OTHER THAN PLACING AN ORDER THROUGH EMPLOI.COM.NG
- Employers are granted all rights for work delivered, unless otherwise specified by the Employee in their service description or as agreed with the Employer.
- Emploi retains the rights to use published delivered work for Emploi promotion and marketing purposes.
- Orders can be cancelled on mutual agreement by both the Employer and Employee.
- Employers and Employees are advised to settle disputes between themselves by agreeing to cancel orders by mutual agreement.
- Delivered Orders are automatically marked as complete after 3days from delivery if the Employer does not mark the order as complete or does not request revision.
- Cancelled Orders are automatically marked as cancelled after 3days if either one of the party fails to confirm cancellation.
EMPLOYEE LEVELS
Emploi.com.ng has implemented a levelling system for users based on their sales performance and ratings. The system automatically upgrades or downgrades user levels according to the rules outlined below:
Default Level
- All new users (employees) start at Level 0.
Automatic Level Adjustments
- Levels are automatically upgraded or downgraded based on performance checks.
- The performance checks occur at regular intervals specified below.
Level Eligibility
Recheck Period for Level Updates
- Level 0: Rechecked every 1 month.
- Level 1: Rechecked every 1 month.
- Level 2: Rechecked every 2 months.
Sales Requirements for Upgrade
- The total sales amount before fees is considered to meet the sales requirements.
- Minimum sales requirements:
- Level 1: NGN 100,000 in the last month.
- Level 2: NGN 500,000 in the last month.
Rating Requirements for Upgrade
- Users must achieve a minimum rating of 95% to be eligible for a level upgrade.
The maximum amount per service an employee can charge is dependent on the Employee’s current level.
Maximum Service Pricing by Level
- Level 0: Maximum service price: NGN 300,000.
- Level 1: Maximum service price: NGN 1,000,000.
- Level 2: Maximum service price: NGN 2,500,000.
- Level 3: Maximum service price: NGN 5,000,000.
Scenarios for Level Evaluation
A) Scenario 1:
An employee has a sales requirement of NGN 100,000 to be upgraded from Level 0 to Level 1. The employee completes 2 jobs worth NGN 100,000 each within the month, totaling NGN 200,000 (before fees) and has an overall rating review of 98%.
B) Scenario 2:
An employee registers on 02/05/2020. The employee completes 4 jobs worth NGN 20,000 each, totaling: NGN 80,000 (before fees) and has a rating of 100% by the 02/06/2020. Since the sales requirement is NGN 100,000 in a single month, the employee does not qualify for an upgrade on 02/06/2020.
3. General Terms
- Emploi will not be held accountable for any liability incurred as a result of the purchase or sale of any services hosted on the site, other than our own legal commitments.
- We reserve the right to put any account on hold or disable it permanently due to; breach/violation of these terms of service, any illegal or misuse of the Emploi Site or services.
- Users with disabled accounts will not be able to sell or buy on the Emploi website.
- Users who have had their account disabled as a result of a violation in these terms of service may contact our Customer Support team for more information surrounding the violation and status of the account.
- Subject to Emploi’s approval based on the nature of violations of service terms, users with disabled accounts will be able to withdraw their revenues after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account.
- Disputes should be settled amicably between users or by contacting Emploi Customer Support.
- We may make changes to these Terms of Service from time to time. An updated copy will be made available on this page. You understand and agree that if you use Emploi after the date on which the Terms of Service have changed, Emploi will treat your use of the website as acceptance of the updated Terms of Service.
- Emploi is a registered company in Nigeria and is subject to Nigerian laws.
- Where applicable, all Employers and Employees must ensure that they conform to their local rules and regulations and pay all required taxes associated with the purchase or sale of any service.
4. The Employee
Employees are users who sell their services.
- Employees create services on Emploi to allow employers purchase their services
- Employees may also offer custom offers tailored to the employer’s needs.
- Employees are advised to respond to only the Employer’s Request that they are capable of completing to avoid cancellations or negative reviews.
- All requests, offers and orders and payments are to be done on Emploi. Handling requests, offers and orders outside Emploi can lead to suspension of Employee account.
- The “Employer’s request” feature is not meant for employees to advertise their service. Users who advertise their services through the Employer request option will be at risk of getting their account suspended.
- Employees Emploi account gets credited with 90% of the purchase amount once the order has been marked as completed.
- If an order is mutually cancelled for any reason, the funds paid will be refunded to the employers Emploi account
- Employees will be notified by email when an employer orders a service
- The employee must deliver their completed order on or before the time frame specified in their service. Failure to do so will permit the Employer to cancel the order and may adversely affect the Employee’s ratings due to late delivery.
- Employees may receive tips from Employers for a job well done
- The Employees overall ratings are calculated based on reviews from Employers, orders completed/cancelled and delivery time.
- The Employer and Employee can cancel an order by mutual agreement. This will not have any negative effect on the employee.
- If an Employee alone decides to cancel an order without a good cause, this will have a negative effect on their rating
- For security reasons, Emploi may temporarily disable an Employees ability to withdraw earnings to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behaviour reported by Employers, or associating multiple Emploi accounts to a single withdrawal provider
5. Employer’s
Ordering services
- Where an order is eligible for cancellation (e.g. due to late delivery) it can only be cancelled by Customer Support within 10 days of being marked as completed. After this time, the order cannot be cancelled.
- Services may be purchased by first crediting their Emploi shopping balance using a valid debit card or credit card.
- Once payment is confirmed, a service can be ordered and an order will be created. The Employee will be notified once the Employer has submitted any required information through the order page.
- If the Employer has specific requirements, they can post a request on the site via the ‘Post a Request’ feature located in the Employer section of their account.
- If there is sufficient balance in the Employer’s Emploi shopping balance which is greater than the price of the service required, then payment will be taken from that balance. If not, the Employer will be requested to first top up their shopping balance with sufficient funds before ordering.
- Employers also have the option of purchasing services directly through their card details or Paypal.
- Employers who are satisfied with the service of the Employees can offer tips to the Employees.
- The Employer’s identity will remain anonymous at all times except for the username used in registering. The employer is reminded that in order to protect their privacy, they must not request or provide email addresses, Skype/IM usernames or any other personal contact information except it is necessary in completing the service.
- Payments outside of EMPLOI for services offered on the site are not permitted. If the employer is asked to use an alternative method of payment, they must report it to Emploi’s Customer Support team immediately.
- Certain keywords suggesting the transaction of services outside Emploi are flagged and can result in account termination.
6. Orders – Delivery, Communication, Review & Disputes
- The Employee and Employer is responsible for checking that all files they transfer are free of any viruses or malware. Emploi will not be responsible for any damage incurred as a result of damaged content or files transferred.
- Employees are required to meet the delivery time they specified when creating their Services. Failing to do so will allow the Employer to cancel the order when an order is marked as late and may harm the Employee’s status.
- The Employee must deliver completed files and/or proof of work completed using the ‘Deliver Work’ button.
- Once an order is delivered, the Employer has three days to respond to the Employee with any modifications/revisions (if these are offered) or to file a complaint. After that time, the order will automatically be marked as completed.
- Employers may use the “Request Revisions” while an order is marked as Delivered if the delivered materials do not match the Employee’s description on their service page or they do not match the requirements sent to the Employee at the beginning of the order process.
- Reviews and ratings feedback provided by Employers on delivered/completed orders are an essential tool of Emploi’s rating system. Reviews show the Employer’s overall experience with the Employees and their service.
- Leaving a feedback is compulsory. Feedback reviews will not be removed unless there are clear violations to our Terms of Service.
- To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through Emploi from users within our Community. Purchases arranged, determined to artificially enhance seller ratings, or to abuse the Emploi platform with purchases from additional accounts, will result in a permanent suspension of all related accounts and loss of whatever funds are in such accounts.
- If a dispute arises between the Employer and Employee, the parties are encouraged to try and resolve the matter themselves. If this is not possible then both parties may refer the matter to Emploi’s Customer Support for arbitration.
7. Payment & Withdrawal
Users can Top up their Emploi account/ shopping balance with funds in order to purchase a service/gig. Funds can be added through the “Top Up” button. Withdrawals are final and cannot be reversed.
All orders are handled through and on Emploi. Emploi will release payment to the Employee upon successful delivery and completion of their order. In order to withdraw revenue, the Employee must have a valid account with at least one of the withdrawal methods listed on Emploi. Revenues are only made available for withdrawal after a safety clearance period of 3 business days for local transactions.
Our payment processors impose a fee for withdrawing revenues, so withdrawal fees vary with the withdrawal method chosen.
Once funds have been withdrawn from the Employee’s account, they cannot be re-credited.
8. Rules for Order Cancellation
The following rules outline the conditions and methods for cancelling service orders on the platform. Users are advised to carefully read and adhere to these guidelines to ensure a smooth and fair resolution process.
i. Employee Confirmation Requirement
- The employee must either accept or decline the order within 24 hours of purchase.
- If the employee declines the order: The order will be cancelled, and the employer will be notified with an appropriate message.
- If no action is taken within 24 hours: The order will be automatically cancelled, the employer will be refunded, and the employee will receive negative feedback from the system.
ii. Mutual Cancellation
- Either party (employer or employee) can request a mutual cancellation due to unforeseen circumstances.
- To initiate a mutual cancellation:
- Navigate to the order page.
- Click on the Resolution Centre on the right side.
- Select Request mutual cancellation.
- Both parties will have the opportunity to communicate and confirm the cancellation. Once confirmed, the order will be cancelled, and no negative feedback will be assigned.
iii. Request Arbitration
- If mutual cancellation is not agreed upon, either party may request arbitration by the admin.
- To request arbitration:
- Go to the order page.
- Open the Resolution Centre and select Request arbitration.
- Submit a detailed explanation of the issue for admin review.
- The admin will assess the situation and decide in favour of either the employer or the employee. The decision will be final, and the outcome will be communicated to both parties.
iv. Admin-Initiated Cancellation
- The admin reserves the right to cancel orders directly
- Notifications will be sent to the employee upon such cancellations, and any refunds will be processed accordingly.
v. Auto-Cancellation for Pending Payments
- If a payment is not finalized within the time frame set by the admin (7 days) the order will be automatically cancelled.
vi. Cancellation Due to Account Suspension
- If a user involved in an ongoing order (either employer or employee) is banned temporarily or permanently by the admin, the order will be automatically cancelled. Refunds or other necessary adjustments will be managed by the system.
Note
- All cancellations are subject to the platform’s policies and procedures.
- Negative feedback resulting from auto-cancellations may impact a employee’s reputation; thus, timely action on orders is strongly encouraged.
- For further assistance, users may contact customer support through the appropriate channels.
By using this platform, all users agree to comply with these rules and any additional terms outlined in the Terms
9. Administration Fee
All service purchases on Emploi incur an administration fee. This fee helps us recover some of the payment transaction charges applied by our payment service providers. These providers enable us to offer our members a completely safe, secure and convenient payment platform, greatly reducing the risk of online fraud. The administration fee also helps towards our associated costs in manually handling payments, refunds, order-related disputes, and providing a reliable customer support service. More importantly, the fee means that we can invest more in our Emploi community, bringing improved functionality to the site.
The administration fee is 10% of the amount used in purchasing a service. That is, if an Employer orders a service for ₦5,000.00, upon completion of the service the Employee gets ₦4,500.00 and ₦500 goes to Emploi. Administration fee applies on all tips given as well.
10. Shipping
- Where the Employer purchases a gig/service that requires physical delivery, the Employer will be required to make arrangement with the Employee, by providing a delivery time and place. The Employee will be responsible for all shipping arrangements once the Employer supplies the shipping address. Employee may add shipping charges to the total cost of the service.
- The Employee will upload proof of postage (a valid tracking number).
- Emploi does not handle or guarantee shipping, tracking, quality and condition of items or their delivery and shall not be responsible or liable for any damage or other problems caused, directly or indirectly, as a result of shipping.
11. Privacy & Guidelines
Employee and Employer identities are kept anonymous except for their usernames. In order to protect your privacy, please do not request or provide email addresses, Skype/IM usernames or any other personal contact information.
A user who does not have a service listed cannot be contacted. Only users who have created services can be messaged by potential Employers.
The exchange of all communications, information and files should be performed exclusively through the site using the Emploi messaging system
Posting or sending illegal, potentially offensive, abusive, copyright protected, promotional, spam, violent or otherwise harmful material will result in your account being disabled.
We do not accept services that offer to post or sell false reviews. Any employee found to be offering such services will be removed from the site without prior notice to the user.
Please check service descriptions properly before ordering a service. Emploi is not responsible for the use or outcomes of any service(s) hosted on the site, whether intended or otherwise. Users are encouraged to have only one account on the Emploi network. Users who have more than one account could have all their accounts disabled.
12. Communication, Account Use & Warranty Disclaimer
Communications
By registering as a member on Emploi, you may receive newsletters and other communications via email. See the section below on ‘Communications from the Site’.
Account use
It is the member’s responsibility to use their account for its intended purpose and in line with Emploi’s Terms. Failure to do so may incur an official warning or account suspension (depending on the violation in question). The following actions may attract an official warning or account suspension:
- Encouraging users to buy or sell services outside of the Emploi website
- Sharing personal information or payment information that encourages others registered members to transact outside of the Emploi website
- Sending unsolicited emails to other members about services or products

YOUR USE OF THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FIVERR NOR ANY PERSON ASSOCIATED WITH FIVERR MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE.
